Former contractor sentenced for crimes involving Fort Drum contracts

UTICA, N.Y. (WWTI) – A 61-year-old Sackets Harbor man and former Fort Drum contractor was sentenced for conspiracy to commit wire fraud on Thursday, May 16.

Sean O’Sullivan was sentenced to two years probation and ordered to pay $345,000 in restitution after being sentenced in federal court in Utica on Thursday. He was facing the possibility of up to 20 years in prison and a fine of $20,000.

O’Sullivan pleaded guilty two years ago to trying to get government construction contracts set aside for businesses owned and run by disabled veterans. His former business partner and co-conspirator David Rose of Newport News, Virginia conspired to bid on and earn contracts that they were not entitled to receive, which was defrauding the government.

Rose is a disabled veteran. However, O’Sullivan is not and prosecutors said their company, Sierra Delta Contracting, got more than $3 million of gross revenue from contracts that were fraudulently obtained.

Rose has also pleaded guilty, but hasn’t been sentenced as of yet. Sierra Delta Contract will also pay $750,000 to resolve civil liabilities.

O’Sullivan’s sentence yesterday also related to his prior guilty plea for conspiring to commit an offense against the United States by offering and giving gratuities to Cindy McAleese, a former civilian contracting officer at Fort Drum, from November 2009 through February 2018. With respect to that offense, O’Sullivan admitted that he promised and provided things of value to McAleese, including sports tickets, meals, sexual encounters, and time and attention, for and because of official action taken by McAleese on O’Sullivan’s behalf
